Death on a brain basis is a clinical and legal determination, not a description of a deep coma. Under Canada's 2023 guideline, death means permanent cessation of brain function, demonstrated by absent consciousness, absent brainstem reflexes, and absent capacity to breathe independently. Permanent means that brain function will not resume spontaneously and that no intervention will be attempted to restore it. The 2023 Canadian guideline provides one framework for death determination after either neurologic or circulatory function is lost. A valid neurologic determination begins with a devastating brain injury of established cause, supported by neuroimaging. The team must then identify and resolve confounders, complete the required clinical assessment, perform a formal apnea test, and document the findings. The NP's role is governed by provincial legislation, institutional policy, and credentialing. An NP may prepare the patient, verify prerequisites, assist or participate in assessment where authorized, monitor for instability, communicate with the family, and coordinate the organ donation process.
