NurseNest Terms of Service

Welcome to NurseNest. These Terms of Service ("Terms") govern your access to and use of the NurseNest website, applications, content, study tools, question banks, practice tests, flashcards, notes features, blog content, emails, and related services (collectively, the "Services").
By accessing or using the Services, creating an account, starting a trial, purchasing a subscription, or clicking to accept these Terms, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Who We Are
NurseNest is an educational platform that provides nursing and allied health exam preparation materials, including lessons, quizzes, rationales, flashcards, study notes, practice tests, blog content, and related study tools.
For purposes of these Terms, "NurseNest," "we," "us," and "our" means NurseNest, located at Ontario, Canada, with support contact at [email protected].
Eligibility
You must be at least the age of majority in your jurisdiction, or have permission from a parent or legal guardian who agrees to be bound by these Terms on your behalf, to use the Services. By using the Services, you represent that you are legally able to enter into this agreement.
Educational Use Only
NurseNest is provided for educational and informational purposes only. The Services do not provide medical advice, nursing advice, diagnosis, treatment recommendations, clinical supervision, employment advice, licensure guarantees, legal advice, or professional certification decisions.
Your use of NurseNest does not create a nurse-patient relationship, educator-student institutional relationship, employment relationship, or regulated professional advisory relationship with us.
You remain solely responsible for your study decisions, exam preparation choices, patient-care decisions, clinical judgment, workplace actions, and compliance with professional and regulatory requirements.
Account Registration and Security
To access some features, you must create an account and provide accurate, current, and complete information. You agree to:
keep your login credentials confidential
not share your password or account access with any other person
promptly update inaccurate information
notify us immediately of unauthorized access or suspected account misuse
You are responsible for all activity that occurs under your account.
Individual License; No Sharing
Subject to these Terms and any active subscription, NurseNest grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your own personal, non-commercial study use.
Your account is for one individual user only. You may not:
share your login credentials
allow multiple users to access a single account
resell, sublicense, distribute, rent, lease, lend, or transfer access
use the Services for institutional classroom distribution, tutoring resale, or commercial coaching redistribution without written permission
We may use reasonable technical and security measures to detect and prevent unauthorized sharing, including session controls, access monitoring, anomaly detection, anti-copy measures, rate limits, and entitlement checks.
Subscription Plans, Trials, and Billing
Certain features require payment. Subscription details, including pricing, billing interval, and included features, will be shown at checkout.
By purchasing a subscription or starting a paid trial that converts into a subscription, you authorize us and our payment processor to charge your payment method for the applicable recurring fees, taxes, and any other disclosed charges until you cancel.
Unless otherwise clearly stated at checkout:
subscriptions renew automatically at the end of each billing cycle
renewal occurs using the payment method on file
fees are charged in advance for the upcoming billing period
taxes may apply depending on your jurisdiction
You are responsible for keeping your payment information current.
Cancellation
You may cancel your subscription at any time through your account settings or by contacting support at [email protected]. Unless required by law or expressly stated otherwise, cancellation stops future renewals but does not retroactively cancel charges already incurred for the current billing period.
If you cancel, your paid access generally continues until the end of the current paid term, after which your subscription will not renew.
Refunds
Our refund policy is described in our Subscription, Cancellation, and Refund Policy, which is incorporated into these Terms by reference.
Except where required by law or expressly offered by us in writing:
subscription fees are non-refundable
partial billing periods are not prorated
forgetting to cancel does not automatically entitle you to a refund
dissatisfaction due to study outcome, exam result, time constraints, or preference changes does not automatically entitle you to a refund
Nothing in these Terms limits any non-waivable consumer rights you may have under applicable law.
Access Rights and Paywall Enforcement
Access to premium content depends on your active entitlement, which may be based on your subscription plan, country, exam pathway, tier, product selection, trial status, and account standing.
We may:
show previews or partial content before purchase
restrict access to premium features unless you have an active entitlement
limit or revoke access if a payment fails, a charge is reversed, a subscription expires, or your account is suspended for misuse
use server-side and client-side content protection measures, including watermarking, rate limiting, anti-copy deterrence, print restrictions, device/session controls, and content masking
Access to one exam, tier, or country pathway does not necessarily include access to all pathways, products, or geographies.
Content Ownership
All content and materials available through NurseNest, including without limitation text, lessons, questions, answer choices, rationales, explanations, flashcards, quizzes, practice tests, notes interfaces, site design, code, graphics, branding, blog posts, metadata, templates, videos, images, and compilations, are owned by NurseNest or its licensors and are protected by copyright, trademark, trade secret, and other laws.
No ownership rights are transferred to you. You receive only the limited access rights expressly described in these Terms.
Prohibited Conduct
You may not, and may not assist, encourage, or permit any third party to:
copy, reproduce, republish, download, upload, post, transmit, or distribute premium content except as expressly allowed
capture or compile question banks, rationales, lessons, or answer sets for redistribution
scrape, crawl, spider, harvest, or extract data from the Services through automation or otherwise
use bots, scripts, browser automation, AI agents, extensions, or bulk collection tools to retrieve content
bypass paywalls, entitlement checks, access controls, watermarking, rate limits, print restrictions, or technical protections
reverse engineer, decompile, or attempt to derive source code or hidden functionality
frame or mirror the Services
interfere with the operation, performance, or security of the Services
use the Services to build or improve a competing service, dataset, model, or product
share accounts or access on behalf of others
upload malicious code, phishing content, or harmful material
impersonate another person or misrepresent your affiliation
use the Services in violation of law, regulation, exam rules, or professional standards
User Notes and User Content
If the Services allow you to create notes, comments, uploads, or other user-generated content ("User Content"), you retain your ownership in that User Content, but you grant NurseNest a non-exclusive, worldwide, royalty-free license to host, store, process, display, reproduce, and use that User Content solely as necessary to operate, maintain, secure, improve, and provide the Services.
You represent that you have the right to submit your User Content and that it does not violate law or any third-party rights.
We may remove User Content that violates these Terms, creates legal risk, or threatens the integrity or safety of the Services.
Accuracy; No Guarantee of Results
We work to make the Services useful and accurate, but we do not guarantee that:
content is error-free or complete
every rationale or explanation will be free from ambiguity
any specific exam blueprint, question style, or licensing body preference will remain unchanged
use of NurseNest will result in passing an exam, obtaining licensure, gaining employment, improving grades, or achieving any particular result
Exam standards, policies, and blueprints may change over time. You are responsible for verifying official requirements with the relevant exam provider or regulator.
AI-Generated or Assisted Content
Some content, workflows, editorial systems, or tools may use automated or AI-assisted drafting, summarization, tagging, clustering, or scheduling. Such outputs are reviewed and managed as part of our content operations, but automated systems may still produce errors, omissions, or wording that requires human judgment. You should use your own critical thinking and professional study judgment when reviewing any content.
Availability and Changes
We may update, modify, suspend, remove, or discontinue any part of the Services at any time, including features, pathways, content, pricing, supported products, and technical protections.
We do not guarantee uninterrupted availability. Scheduled maintenance, outages, feature changes, payment failures, security measures, or legal compliance requirements may affect access.
Monitoring, Security, and Enforcement
To protect our business, learners, and content, we may monitor account activity, access patterns, usage volume, payment status, entitlements, device/session behavior, abuse signals, and content-protection triggers.
We may investigate suspected abuse and may suspend, throttle, restrict, or terminate access where we reasonably believe there is:
account sharing
scraping
unusual bulk access
unauthorized copying
payment fraud
chargeback abuse
policy evasion
risk to the platform or other users
Chargebacks and Payment Disputes
If you initiate a chargeback, payment dispute, reversal, or unauthorized-payment claim, we may provide relevant evidence to our payment processor, financial institutions, or card networks, including account records, checkout acceptance records, logs showing access or use, correspondence, billing descriptors, IP/device/session records, and copies of applicable policies, to defend the transaction to the extent permitted by law.
If a payment is reversed or disputed, we may suspend or terminate your access while the matter is unresolved, and we may deny future purchases where permitted by law.
Third-Party Services
The Services may integrate with or rely on third-party providers such as payment processors, analytics providers, hosting vendors, authentication tools, email services, media storage providers, or customer support systems. We are not responsible for third-party services except as required by law.
Your use of third-party services may also be governed by their terms and policies.
Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, disclose, store, and protect personal information.
Termination
We may suspend or terminate your account or access immediately, with or without notice, if:
you violate these Terms
your payment fails or is reversed
your subscription expires
we detect abuse, fraud, or security risk
we are required to do so by law or to protect the platform
On termination, your right to use the Services ends immediately, except for any rights that by their nature survive termination.
Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or collateral, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, quiet enjoyment, or availability.
Limitation of Liability
To the maximum extent permitted by law, NurseNest and its owners, directors, officers, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost business opportunity, exam failure, employment consequences, professional consequences, emotional distress, or procurement of substitute services, arising out of or relating to the Services or these Terms.
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Services or these Terms will not exceed the greater of:
the amount you paid to NurseNest for the Services in the 3 months before the event giving rise to the claim, or
CAD $100.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnity
You agree to defend, indemnify, and hold harmless NurseNest and its affiliates, owners, officers, employees, contractors, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to:
your use or misuse of the Services
your violation of these Terms
your User Content
your violation of law or any third-party rights
Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles.
You agree that the courts located in Ontario, Canada will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services, except where applicable consumer law provides otherwise.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will post the updated version and update the "Last Updated" date. Continued use of the Services after the effective date of revised Terms constitutes acceptance of the revised Terms.
