Ethics in NP Practice: Nonmaleficence, Justice, and Ethical Decision-Making

Clinical meaning

Building on the principles of autonomy and beneficence, the NP must also integrate NONMALEFICENCE and JUSTICE into clinical practice. NONMALEFICENCE ('first, do no harm' -- primum non nocere) obligates the NP to avoid causing unnecessary harm to patients. This principle extends beyond obvious physical harm to include psychological harm (e.g., insensitive disclosure of bad news), harm through omission (e.g., failure to order indicated screening), iatrogenic harm (e.g., polypharmacy, unnecessary procedures), and harm from premature diagnostic closure (e.g., anchoring on an incorrect diagnosis). The principle of DOUBLE EFFECT is a critical ethical framework for the NP: an action with both a good effect (intended) and a bad effect (foreseen but unintended) is ethically permissible when: (1) the action itself is not intrinsically wrong, (2) the good effect is intended and the bad effect is merely foreseen (not intended), (3) the bad effect is not the means by which the good effect is achieved, and (4) there is proportionate reason -- the good outweighs the bad. The classic clinical application is palliative sedation: administering opioids/sedatives to relieve intractable suffering (good effect) while accepting that respiratory depression may hasten death (foreseen but unintended bad effect). JUSTICE in healthcare encompasses DISTRIBUTIVE justice (fair allocation of limited resources), PROCEDURAL justice (fair decision-making processes), and SOCIAL justice (addressing health inequities and social determinants of health). The NP faces justice issues in: equitable resource allocation (triaging appointments, prescribing expensive vs. generic medications), addressing healthcare disparities (racial, socioeconomic, geographic), and advocating for policy changes that promote health equity. VERACITY (truthfulness) and FIDELITY (faithfulness to promises and professional obligations) are additional principles that guide the NP's ethical conduct: veracity requires honest disclosure of diagnoses, prognoses, and medical errors; fidelity requires keeping promises to patients, maintaining competence, and fulfilling the obligations of the NP role.

Risk factors: - Medical error and disclosure dilemmas: when a clinical error occurs (medication error, diagnostic delay, procedural complication), the NP faces the ethical obligation of veracity -- honest disclosure to the patient/family, which may conflict with fear of litigation; disclosure is both ethically required and associated with BETTER legal outcomes than concealment - Futile or potentially inappropriate treatment: family or patient requests for interventions that the clinical team judges offer no meaningful benefit (e.g., CPR for end-stage metastatic cancer, aggressive ICU care for irreversible multi-organ failure); these situations create tension between autonomy, beneficence, nonmaleficence, and justice (resource allocation) - Social determinants of health inequity: patients experiencing poverty, food insecurity, housing instability, racism, and limited healthcare access face systemic barriers that the NP must recognize and address through advocacy and resource connection; treating only the biomedical condition while ignoring social context violates justice - Implicit bias in clinical decision-making: unconscious biases based on race, gender, age, weight, socioeconomic status, mental health diagnosis, or substance use disorder affect clinical assessments, pain management, referral patterns, and communication quality; the NP must actively work to identify and mitigate personal biases - Scope of practice boundary violations: practicing beyond legal scope (prescribing outside authorized categories, performing procedures not covered by credentialing, providing care outside area of competence without appropriate consultation) violates nonmaleficence and professional ethics - Conflicts of interest: pharmaceutical industry relationships (gifts, continuing education sponsorship, speaker fees), financial incentives that influence referral patterns, ownership interests in diagnostic facilities, and employment pressures to see more patients or order more tests can all compromise ethical practice - Whistleblowing and organizational ethics: the NP may observe unethical or unsafe practices by colleagues, institutions, or systems; professional obligation to report conflicts with loyalty, fear of retaliation, and potential career consequences; regulatory reporting obligations exist for unsafe practitioners
